中国与越南婚姻家庭制度比较研究 |

摘 要:中国与越南自重新建国后即开始了本国婚姻家庭领域的立法工作。进入21世纪,又开始了婚姻家庭立法的修订工作。两国婚姻家庭法律制度在立法背景、立法体例、立法理念及具体制度等方面既有许多相似之处,又有不同之处。探讨两国婚姻家庭制度的异同,借鉴其成功的立法经验,对完善我国的婚姻家庭立法具有重要的启迪意义。

Abstract:After the reconstruction, China andVietnam respectively started legislationwork onmarital family system atonce·Since the21st century, they also started theirnational legislative revisionwork aboutmarital system·There aremany similarities and dissimilari-ties aboutmarital family system in both countries among legislative background, legislative style, legislative ideas, concrete systemsand so on·It is important to improve China’s legislation inmarital family system by dicussing their similarities and differences, andby learning from its legislative successful experience·

中越两国历史联系紧密,源远流长,虽在近现代有所疏远,然而并未完全间断,尤其自上世纪90年代中越关系实现正常化后,两国的交流更加频繁。在交往中,两国的法律理念互相渗透,彼此影响着对方。探寻与比较两国的法律制度,既有利于促进文化的交流,也有助于两国相互取长补短,共同促进本国法律事业的进步。本文通过比较两国在婚姻家庭制度上的异同,目的是为我国婚姻家庭法律制度的完善提供参考意见。
